Both Danny O’Brien and Mark Kavanagh have successfully appealed their cobalt related charges with both trainers able to resume training immediately.
VCAT outcome:
Danny O’Brien has successfully appealed his four year ban for cobalt related charges.
Mark Kavanagh has successfully appealed his three year ban for cobalt related charges.
Hearing:
Justice Greg Garde dismissed the charges against the trainers at the Victorian Civil and Administrative Tribunal on Friday.
Kavanagh and OβBrien had appealed respective three and four-year disqualifications they received after five horses returned positive results for cobalt in 2014.
VCAT found from April 2014 – Aug 2015 procedure for cobalt testing adopted by RV “substantially departed” from requirements set out in rules.Β Legal consequence is that the test results were “inadmissible”.
