The Court Of Appeal this morning has found trainers Danny O’Brien and Mark Kavanagh not guilty for the administration of cobalt which incurs hefty charges.
Racing Victoria took the long-running case to the Court of Appeal, after the Victorian Civil and Administrative Tribunal overturned O’Brien and Kavanagh’s respective four- and three-year disqualifications for administering cobalt.
The Court of Appeal on Friday partly upheld Racing Victoria’s appeal while also dismissing a charge the trainers administered cobalt, which means the case will be sent back to VCAT to determine a penalty for presentation.
Danny O’Brien and Mark Kavanagh are likely to only receive fines for their presentation charges.
“Four Supreme Court judges have now exonerated us. It’s time to move on,” O’Brien said
