Apprentice Talia Rodder has been cleared of a running and handling charge and has had a six-week suspension overturned.
The Racing Appeals and Disciplinary Board handed down its finding on Thursday after hearing evidence relating to her ride on Serene Tanie at Moonee Valley on November 19.
Rodder was charged under AR 135b for failing to take all reasonable and permissible measures to ensure Serene Tanie had full opportunity to win or to obtain the best possible place in in the Corporate Interiors Handicap (1500m).
The Victorian Jockeys Association (VJA) claimed it was a test case for all jockeys on the grounds Rodder made an error of judgment as an apprentice and there was no intent which rule AR 135b implies.
Stewards alleged that from the 1100m to the 800m Rodder failed to make sufficient effort to restrain her mount and from the 800 metres allowed the four-year-old mare to stride forward.
They also asserted that passing the 600 metres Rodder placed Serene Tanie under further pressure by riding the mare along.
Serene Tanie was timed at 59.59 seconds for the first 1000 metres of the in the Corporate Interiors Handicap (1500m) and 47.73s for the first 800m.
However the RAD Board, chaired by Judge Russell Lewis, found the charge could not be sustained.
Last Friday night Serene Tanie, ridden by Chris Symons, led all the way to win over 1600 metres at Moonee Valley.
