Jockey Eliseo Ruiz is the subject of an investigation following his ride in Tuesday’s ninth event at Parx Racing, where he surrendered a significant lead after not using the whip in the home straight.

Ruiz partnered Bailout Billy in a first-level allowance and established a clear advantage early before entering the stretch well in front. However, the four-year-old filly began to weaken as challengers approached. Despite glancing behind multiple times, Ruiz did not appear to place his mount under strong riding pressure, and the pair were eventually overtaken by 9-5 favourite Cocktail Humor, who scored by half a length.

According to the Paulick Report, Thomas Chuckas, director of the Bureau of Thoroughbred Horse Racing for the Pennsylvania Horse Racing Commission, confirmed that stewards were examining the ride. Jason Klouser, director of enforcement, also stated in an email on Wednesday morning that the PHRC had commenced an investigation into the race. The performance has drawn criticism across social media, with some observers questioning whether the jockey made sufficient effort to win.

Ruiz’s agent, Troy Matty, responded publicly on Facebook in defence of the rider, indicating that the tactics were in line with trainer J. Guadalupe Guerrero’s instructions.

“Eliseo is a hardworking, respectful young rider who takes pride in doing things the right way,” Matty wrote. “He is well-regarded by trainers and horsemen for his professionalism, honesty, and integrity. It’s important to understand that Bailout Billy is not a horse that can be whipped or aggressively handled. Eliseo was under specific instructions, as usual, from the trainer. He followed those instructions and rode the horse responsibly, giving him the best chance possible within those limits.”

Bailout Billy’s racing pattern has been consistent across her 14 starts, including eight with Ruiz aboard, typically showing early speed before fading late. Ruiz has partnered the filly in three of her four career wins, each achieved without use of the whip.

In a starter allowance at Parx on November 25, Bailout Billy opened up a 2 1/2-length lead turning for home before tiring late. Ruiz again refrained from using the whip, maintaining control to win by a length.

In a similar race the previous month, the pair held a six-length advantage at the top of the straight and narrowly held on, winning by 1 1/4 lengths without the jockey resorting to the crop.

Earlier in the filly’s career, Ruiz did use the whip, including during a maiden special weight in June 2025. On that occasion, Bailout Billy led by five lengths before weakening in the final furlong. Despite Ruiz attempting to urge her, the filly shifted inwards toward the rail and was ultimately defeated by 2 3/4 lengths.

Under Title 7 of the Pennsylvania Code, Section 305.290, it is stated: “All horses shall be ridden out in every race. A jockey shall not ease up or coast to the finish, without reasonable cause.”
