Ben Melham is free to ride Mid Summer Music in the Tattersall’s Tiara at Eagle Farm having been granted a stay of proceedings pending an appeal against suspension.

The jockey was outed for careless riding earlier this week at the resumption of an inquiry into a fall at Flemington which left apprentice Katelyn Mallyon with a spinal injury.

His suspension was due to take effect on Friday, ruling him out of the ride on the Stradbroke Handicap winner in the Tiara (1400m), the final Group One race of the Australian season.

The Racing Appeals and Disciplinary Board granted Melham a stay on Friday ahead of hearing his appeal on Monday.

Melham replaces Luke Nolen on Mid Summer Music with the latter on Black Caviar duty at Royal Ascot this weekend.

The last time Melham replaced Nolen in a Group One race he steered Black Caviar to her first win at the highest level in the Patinack Farm Classic in November 2010.

Mid Summer Music was on the third line of betting at $6.50 with TAB Sportsbet on Friday with Soft Sand the $4 favourite ahead of Shopaholic ($5.50).

Trainer Peter Moody has admitted he had a low opinion of Mid Summer Music early in her career but has persevered, with the mare delivering a surprise Group One in the Stradbroke two weeks ago.

Melham has ridden Mid Summer Music on several occasions including her win in the Group Three Cockram Stakes at Caulfield in August last year.

He was also aboard when she finished third in the 2011 Patinack Farm Classic won by her star stablemate Black Caviar.
