Charge 1 – AR 175(a)

AR 175 The Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:

(a) Any person, who, in their opinion, has been guilty of any dishonest, corrupt, fraudulent, improper or dishonourable action or practice in connection with racing.

In the Stewards’ opinion, Mr Stanley’s conduct was a dishonest, fraudulent, improper or dishonourable action in connection with racing and contrary to AR 175(a) in that, amongst other things, Mr Stanley:

misrepresented to relevant owners that the horse had been sold for $200,000 when in fact it had been sold for a significantly higher amount; and/or

retained proceeds of the sale totalling $70,000 for his personal benefit without the knowledge, authority and consent of relevant owners of the horse; and/or

deliberately sought to obtain, and obtained, a financial advantage by deceiving relevant owners of the horse.

The summary of the particulars is that on 20 May 2015 the following payments occurred and were not, at any relevant time, disclosed to relevant owners of Equita:

Mr Stanley received $20,000 in cash from Mr Schofield at Randwick Racecourse, which was purportedly as a commission in respect of the sale; and

a payment of $250,000 from Mr Schofield was received into the account of Mr Stanley’s wife, Mrs Paris Stanley, in respect of the sale of the horse.

On 21 May 2015, Mr Stanley authorised the transfer of $200,000 from Mrs Stanley’s account to his training company, Cloud9Thoroughbreds’ account, and that transfer was made. In doing so, Mr Stanley retained $50,000 of the $250,000 amount transferred to Mrs Stanley’s account by Mr Schofield in respect of the sale of the horse.

Between 21 May 2015 and 1 June 2015, Mr Stanley authorised payments to be made to the owners of the horse in respect of the sale, based on a sale price of $200,000, and those payments were made.

Charges 2 & 3: AR 175(g)

AR 175 The Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:

(g) Any person who gives at any interview, investigation, inquiry, hearing and/or appeal any evidence which is false and/or misleading in any particular.

The summary of the particulars for the charges are that Mr Stanley provided false and/or misleading evidence regarding the financial terms of Equita’s sale during interviews with RV Stewards on 9 and 11 June 2015 respectively.

Charge 4: AR 175(gg)

AR 175 The Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:

(gg) Any person who makes any false or misleading statement or declaration in respect of any matter in connection with the administration or control of racing.

The summary of the particulars is that Mr Stanley made a false and misleading statement or declaration in connection with the administration and/or control of racing on 11 June 2015 when tendering evidence upon request to RV stewards.

Glyn Schofield

Charge: AR 85C

AR 85 The Principal Racing Authority (or the Stewards exercising powers delegated to them) may penalise:

(1) A licensed jockey or an apprentice jockey shall not, without the express written permission of the Principal Racing Authority that has issued his licence, have any interest in or be otherwise involved in the buying, selling, trading or leasing of thoroughbred bloodstock.

(2) A Principal Racing Authority may impose terms or conditions on a permission granted under sub-rule (1).

(3) A person who fails to comply with sub-rule (1) or with a term or condition imposed under sub-rule (2) is guilty of an offence.

(4) For the purpose of this rule thoroughbred bloodstock means:

(a) a thoroughbred horse included in the Australian Stud Book or the Stud Book of a recognised turf authority; or

(b) a thoroughbred horse registered to race by the Registrar of Racehorses or by a recognised turf authority.

The summary of the particulars is that Mr Schofield did not, at any relevant time, hold any express written permission of the RV Stewards, as contemplated by AR 85(1), when acting as agent for the Hong Kong purchaser in the buying and/or selling and/or trading of Equita.

Stewards allege that following receipt of the payment of $290,000 from the Hong Kong purchaser in respect of the sale of Equita that Mr Schofield;

a) retained $20,000 for himself, purportedly as a commission;

b) withdrew $20,000 in cash and gave that cash to Mr Stanley on about 20 May 2015 at Randwick Racecourse, purportedly as a commission; and

c) transferred the balance of $250,000 to the bank account of Mrs Stanley upon the direction of Mr Stanley.
